Terms & Conditions
Last updated:
These terms apply when you use a booking widget powered by Octransfer to get a quote, book, pay for, look up or cancel a transfer on the website of a transport company. Please read them before you book: by completing a booking you accept them.
The short version: Octransfer is the technology, not the transport company. The ride is provided by the company whose website you booked on. Your transport contract is with that company, the prices and cancellation rules are theirs, and your payment goes to them.
1. Who we are and what we do
Octransfer provides software that transfer, shuttle and chauffeur companies use to run their business, including the booking widget they place on their own websites. In these terms, "Octransfer", "we" and "us" mean the provider identified in the "Contact" section; "Operator" means the transport company whose website shows the booking widget and that carries out your ride; and "you" means the person who uses the widget to make or manage a booking.
Octransfer acts only as a technology intermediary between you and the Operator. We supply the tools that show you the Operator's vehicles and prices, collect the details of your trip, pass your payment to the Operator's payment processor and deliver your booking to the Operator.
2. What Octransfer is not
So there is no doubt about who does what:
- We do not provide transportation services. We are not a carrier, a taxi or limousine company, a travel agent or a tour operator.
- We do not own, lease or operate vehicles, and we do not employ, contract, select or supervise drivers.
- We are not a party to the transport agreement between you and the Operator, and we do not act as the agent of either of you.
- We do not set prices, availability, or cancellation and refund rules. The Operator does.
- We do not receive, hold or transfer the money you pay for a ride.
3. How a booking works
You enter your trip (pick-up and drop-off, date and time, passengers, luggage and, for airport pick-ups, your flight number), and the widget shows the vehicles and prices the Operator has set for that trip. You then choose a vehicle and any extras, give your contact details and pay.
When the payment is approved, your booking is confirmed and delivered to the Operator, and a confirmation is e-mailed to the address you gave. That confirmation, and the transport agreement behind it, are between you and the Operator.
The Operator may contact you about your booking, and may decline or cancel it, for example if the vehicle becomes unavailable or the information you gave is wrong. If that happens, any refund is handled by the Operator under its own rules and the law that applies.
The Operator may have its own terms for the ride. Where they cover the transport itself, such as waiting time, delays, luggage limits or conduct in the vehicle, the Operator's terms apply to the ride. These terms govern your use of Octransfer's technology.
4. Prices and payment
- Prices, taxes, fees, extras and currency are set by the Operator. The widget calculates the price from the Operator's rates at the moment you book, and the amount shown before you pay is the amount charged.
- Payments are processed by Square, a third-party payment processor, into the Operator's own merchant account. Where your device supports them, Apple Pay and Google Pay also run through Square. The charge is made by and for the Operator, whose name will normally appear on your card statement.
- Your card details are typed into secure fields served by Square and go directly to Square. They never reach Octransfer's servers, and we never see or store your card number or security code.
- If the widget shows a price that is obviously wrong because of a technical error, the Operator may cancel the booking and refund you in full.
Questions about a charge, a receipt or an invoice go to the Operator. Chargebacks and payment disputes are handled between your card issuer, the Operator and its payment processor. We will help the Operator with the booking records where we can.
5. Changes, cancellations and refunds
Cancellation and refund rules are set by the Operator: for example, how much notice is required before departure, or whether a vehicle is non-refundable. Before you confirm a cancellation, the widget shows whether your trip is eligible for a refund and the estimated amount, according to those rules.
You can cancel a booking yourself from "My trips", using the link we e-mail to the address on the booking. For any other change, such as a new time, address, number of passengers or vehicle, contact the Operator directly.
Refunds are issued by the Operator to the original payment method, through its payment processor. How long they take to appear depends on your bank or card issuer, and is usually several business days.
Decisions about refunds outside those rules, such as for a delay, a no-show or a problem during the ride, belong to the Operator. Octransfer cannot grant, refuse or reverse a refund on the Operator's behalf.
6. Your responsibilities
- Give accurate and complete information: addresses, date and time, flight number, number of passengers and pieces of luggage, and a phone number and e-mail where you can be reached. A wrong detail can make the ride fail, and the Operator's rules decide what happens then.
- Choose a vehicle that fits your group and luggage, and tell the Operator in advance about special needs, such as child seats or accessibility requirements.
- Be ready at the pick-up point at the agreed time, and follow the law and the Operator's rules during the ride.
- Be at least 18 years old. If you book for other people, you confirm that you are allowed to do so and that you will tell them how their details are used, as explained in our Privacy Policy.
- Use only a payment method you are entitled to use.
7. The Operator's responsibilities
The Operator alone is responsible for the transport service: holding the licences, permits and insurance the law requires; the condition, safety and cleanliness of its vehicles; the selection, training and conduct of its drivers; punctuality and the performance of the ride; its prices, taxes and invoices; and its compliance with transport, consumer and tax laws.
Operators use Octransfer under a separate agreement with us, which requires them to handle their customers' data lawfully and to honour the bookings and rules they publish through the widget. Octransfer does not inspect vehicles or vet drivers, and makes no promise about the quality of any Operator's service.
8. Your personal data
The details you give in the widget are delivered to the Operator so it can carry out your ride. Octransfer handles them on the Operator's behalf. What is collected, who receives it, how long it is kept and how to exercise your rights are explained in our Privacy Policy, at octransfer.com/policy.
9. Third-party services
The widget relies on services run by other companies: Google Maps for address search and the route map, Square for payments, and Apple Pay and Google Pay as payment options. Your use of them is also subject to their own terms and privacy policies.
We choose these providers carefully, but we do not control them and are not responsible for their availability, errors or policies.
10. Acceptable use
You agree not to:
- make false, fraudulent or speculative bookings, or use a payment method without authorisation;
- access the widget or its systems by automated means, such as bots, scrapers or bulk requests, or try to get around their usage limits;
- probe, scan or test the security of the service, or interfere with how it works;
- copy, modify, decompile or reverse-engineer the software, except where the law expressly allows it;
- use the service in breach of any law or of anyone else's rights.
We may block access, and the Operator may cancel bookings, when there are reasonable signs of fraud or abuse.
11. Intellectual property
The widget, its software and design, and the Octransfer name and logo belong to Octransfer or its licensors. We give you a limited, personal, non-exclusive and revocable right to use the widget to make and manage your own bookings. The Operator's name, logo, vehicle photos and content belong to the Operator.
12. Availability and disclaimer
We work to keep the widget available and accurate, but we provide it "as is" and "as available". It may occasionally be unavailable for maintenance, updates, or reasons beyond our control, such as an outage at one of our providers.
To the fullest extent permitted by law, Octransfer disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We give no warranty of any kind about the transport service, which is the Operator's.
13. Limitation of liability
Because Octransfer does not provide the transport, we are not liable for anything that arises from the ride or from the Operator's acts or omissions. That includes delays, missed pick-ups, cancellations, accidents, personal injury, damage to or loss of property, the conduct of drivers, the condition of vehicles, and refund decisions.
To the fullest extent permitted by law, Octransfer is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost opportunities. Our total liability for any claim relating to the widget is limited to the greater of one hundred US dollars (USD 100) and any amount you paid to Octransfer itself in the twelve months before the claim.
Nothing in these terms excludes or limits liability that the law does not allow to be excluded or limited, including liability for fraud, wilful misconduct or gross negligence, or takes away rights you have as a consumer under the law that applies to you.
14. Indemnification
To the extent permitted by law, you agree to compensate Octransfer for claims, losses and reasonable costs, including legal fees, that result from your fraudulent use of the widget, your breach of these terms, or your violation of the law or of someone else's rights.
15. Questions and complaints
Most questions are answered fastest by the right party:
- About the ride, the price, a charge or a refund: contact the Operator. Its contact details are on its website and in your booking confirmation.
- About the widget itself (something not working, a security concern, or these terms): write to us at the address in the "Contact" section. If your message is really for the Operator, we will forward it to them.
We will try to resolve any dispute with you informally first. Please contact us and allow us 30 days to respond before starting legal proceedings.
16. Governing law and jurisdiction
These terms, and any dispute about your use of Octransfer's technology, are governed by the laws of the Federative Republic of Brazil, and the courts of Brazil have jurisdiction over them.
This does not take away the protection of the mandatory consumer laws of the country where you live, or your right to bring a claim in the courts where you live when that law gives you that right.
The transport agreement between you and the Operator is governed by the law that applies to it, usually the law of the place where the Operator is established or where the ride takes place.
17. General
- If any part of these terms is found invalid or unenforceable, the rest remains in force.
- If we do not enforce a right straight away, we have not given it up.
- We may transfer our rights and obligations under these terms as part of a reorganisation, merger or sale of our business, without reducing your rights.
- These terms, together with our Privacy Policy, are the entire agreement between you and Octransfer about the use of the widget. Where relevant, they also apply to your use of octransfer.com.
18. Changes to these terms
We may update these terms when the service or the law changes. The date at the top of this page shows when they last changed. The version in force when you make a booking is the one that applies to that booking; a change never applies retroactively to a booking already made.
